Public Offer
This document is a public offer (hereafter «Offer») in accordance with Art. 395 of the Civil Code of the Republic of Kazakhstan. The Offer is addressed to any legally-capable individual or legal entity who accepts it by paying for a Service tier.
1. Subject of the Offer
The rights holder of the PoZapisi Service (hereafter «Provider») undertakes to grant the Business (hereafter «Customer») access to software (SaaS) for managing online client bookings, and the Customer undertakes to pay for the service in accordance with the chosen tier.
2. Acceptance of the Offer
Acceptance — registration at business.pozapisi.kz and payment for the first month of subscription, or explicit consent in the interface. From the moment of acceptance, the Offer becomes a contract between the Provider and the Customer.
3. Cost and payment terms
- Price — per the tier in effect at pozapisi.kz/en/#pricing at the time of payment.
- All prices are stated without VAT. If the Provider becomes a VAT payer, tiers will be recalculated with 30 days' notice.
- Settlement currency — Kazakhstani tenge (KZT).
- Trial period — 14 days free. No card required.
- Subscription billing — automatic, monthly, on the recurring period date.
- No refunds for the unused remainder of a paid period.
4. Rights and obligations of the parties
The Provider undertakes to:
- Provide access to the Service according to the tier.
- Maintain Service availability of at least 99.5% per month (uptime).
- Ensure the protection of the Customer's and their clients' personal data (see Privacy Policy).
- Notify of tier and Terms changes 30 days in advance.
- Provide technical support via ${CONTACT_EMAIL_SUPPORT}.
The Customer undertakes to:
- Pay for the tier on time.
- Use the Service in accordance with the Terms of Use.
- Comply with Kazakhstan consumer protection law in relations with their own clients.
- Not use the Service for spam, fraud, or other unlawful acts.
5. Liability of the parties
The parties bear liability in accordance with Kazakhstan law. The maximum aggregate liability of the Provider is limited to the amount paid by the Customer over the last 3 months. The Provider is not liable for indirect losses.
6. Force majeure
The parties are released from liability for partial or complete non-performance caused by force-majeure circumstances.
7. Term and termination
- The Offer is in force from the moment of acceptance until either party withdraws.
- The Customer may terminate the contract at any moment via the Business Dashboard.
- The Provider may terminate the contract upon breach of the Terms, with notice.
- After termination, the Customer's data is retained for 30 days for export.
8. Changes to terms
The Provider may modify the Offer's terms unilaterally. Notice of changes — 30 days in advance via e-mail and Telegram. If the Customer disagrees — they may terminate the contract without penalty.
9. Governing law and jurisdiction
The Offer is governed by the laws of the Republic of Kazakhstan. Disputes — at the location of the Provider.
10. Provider details
Provider details are published in the Business Dashboard after the Customer's registration and on invoices. On request — via ${CONTACT_EMAIL_INFO}.
